Strip searches at the trial of the Brussels attacks: new twist in the case

LThe SPF Justice is appealing the decision of the judge in chambers prohibiting the systematic strip search of the defendants in the trial of the Brussels attacks, Sharon Beavis, spokesperson for the Ministry of Justice, confirmed on Saturday.

The defendants’ lawyers have denounced since the start of the trial the strip searches that have taken place during the transfer of their clients from the prison to the building where the trial is taking place. Six of them therefore cited the Minister of Justice Vincent Van Quickenborne (Open VLD) in summary proceedings, after which the judge in summary proceedings in Brussels banned systematic strip searches at the end of December on the grounds that they violate the European Convention human rights.

If the FPS Justice had indicated that it respected the decision, it had specified that it would examine the possibility of appealing against it. The ministry has now been instructed by Minister Van Quickenborne to effectively appeal the case, spokeswoman Sharon Beavis said on Saturday.

According to several defendants, strip searches are still carried out without individual reasons being provided to them. According to the defense lawyers, it is only a copy and paste of the arguments which have already been submitted to the judge in chambers.
